By accessing and using Absolute Go Pass by Absolute Wellness developed by Tarsoft Sdn Bhd ("we", "us",
"our"), you agree to the following Terms and Conditions that govern the use of this system for fitness
class browsing, membership credit purchases, and class/session booking with our merchant studios.
1. Scope of Service
Absolute Go Pass provides a digital platform for fitness membership and class participation. Core features include:
1.1 User Account Functions
- User Registration, Login, and Forgot Password
- Profile Management and Profile Photo
- Logout
1.2 Class and Booking Features
- Browse Classes and Sessions across Merchant Studios
- Class and Session Booking, Rebooking, and Cancellation
- My Bookings and Booking History
1.3 Membership and Credits
- Credit Package Purchases
- Credit Balance and Transaction History
1.4 User Interaction Tools
- Likes and Favourites for Classes, Sessions, and Merchants
- Notifications & Email Blasts from Merchant Studios
- Contact Us
2. Account Registration
- Users must register with accurate and complete information.
- Users are responsible for maintaining the confidentiality of their account credentials.
- We reserve the right to suspend or terminate accounts found to be fraudulent or abusive.
3. User Responsibilities
- Users agree not to use the system for unlawful or unauthorized purposes.
- Users are responsible for any content they submit, such as profile details or uploaded photos.
- Users must arrive on time for booked classes and follow the rules of the merchant studio.
- Users must ensure their interactions within the system are respectful and legal.
4. Payment, Credits, and Refunds
- Credit packages and their pricing will be clearly communicated before purchase.
- Payments may be processed via FPX and other available payment methods.
- Credits are deducted upon successful class/session booking and are non-refundable once a booking is confirmed, except as otherwise stated in a specific merchant's cancellation policy.
- Refund eligibility for credit package purchases is determined by our refund policy and applicable merchant-specific policies.
5. Bookings and Cancellations
- Bookings are subject to class/session capacity and availability set by the merchant studio.
- Merchant studios may cancel or reschedule classes/sessions, in which case affected users will be notified.
- Users may cancel a booking subject to the cancellation window set by the merchant studio.
- Repeated no-shows or late cancellations may result in restrictions on future bookings.
6. Data Protection and Privacy
- We collect and process personal data in accordance with our Privacy Policy.
- By using Absolute Go Pass, you consent to the collection and use of data as described.
- Users must not misuse personal data accessed through the platform.
7. Intellectual Property
- All content and software provided by Absolute Go Pass are protected by copyright and intellectual property
laws.
- Users retain ownership of content they upload but grant us a non-exclusive license to use it for system
operation and promotional purposes (with consent).
8. System Availability and Limitations
- We strive for 24/7 availability but do not guarantee uninterrupted access.
- We are not liable for losses due to downtime, data loss, or system errors.
9. Termination
- We reserve the right to terminate or suspend user access for violations of these Terms.
- Users may request account deletion at any time.
10. Limitation of Liability
- We are not liable for any indirect, incidental, or consequential damages arising from use of the system.
- Responsibility for the conduct, safety, and quality of a class or session lies with the merchant studio providing it.
11. Changes to Terms
- Continued use after changes indicates acceptance.
12. Governing Law
- These Terms are governed by the laws of Malaysia.
- Any disputes will be subject to the exclusive jurisdiction of the courts in Malaysia.
